The lawyer, from professional secrecy to GDPR compliance
“The lawyer, whether he acts as a controller in the defense of his client’s interests, or as a subcontractor on behalf of a colleague he replaces at the bar, is required to respect the stricter provisions arising from the GDPR. Especially since it is regularly required to process special categories of data, such as health data or data relating to criminal convictions.
Compliance with the GDPR requires a proactive position on the part of the lawyer, since he must be able to demonstrate at any time his compliance with this regulation. Otherwise, he incurs heavy penalties, whether administrative or criminal, and risks being liable to civil liability.
To better understand these obligations, which are also imposed on any liberal profession, on the one hand, the general principles governing the processing of personal data of this professional will be addressed and, on the other, in the form of tutorials, the few concrete measures enabling it to ensure its compliance. ”
